1600 By reference to, The National Motor Freight Traffic Association Classification Guide, all current rules are incorporated into this tariff. R&M Trucking Co. is a bona fide and published member of the Association and is entitled to legal access to all terms, conditions, rules and regulations currently published by the The National Motor Freight Traffic Association. A copy is inserted for reference, and incorporated as item 1610.

1620 Cash on Delivery, (C.O.D.) consignments are the responsibility of the shipper. The shipper must make arrangements with the consignee for payment. R&M will attempt to obtain payment but will hold no liability for non-payment. R&M does not charge a handling fee for Cod’s and can not assume liability for payment.

1620 No one is authorized to change the terms and conditions of this tariff. Expressed or written authorization is invalid. Changes are allowed only by amending the tariff and publishing a revised edition through R&M Trucking Co.
1630 Uniform Bill of Lading:
All consignments negotiated by R&M Trucking Co. shall be subject to the Uniform Bill of Lading published by The National Motor Freight Traffic Association. Any Bill of Lading, or other instrument, negotiated to, or from, R&M Trucking Co. shall serve as a receipt for goods only. No one is authorized to change the terms of the Uniform Bill of Lading published by The National Motor Freight Traffic Association.
1640 Limitations of Liability:
The maximum amount of cargo insurance provided by R&M Trucking Co. is 50 cents per pound, or $250.00 per consignment, which ever is less.

Full value coverage for the invoice amount may be obtained if the following conditions exist:

  1. The declared value is shown in the proper place on the Bill of Lading.
  2. Additional premiums are agreed to, and paid to, R&M Trucking Co., in the amount of $1.50 per $100.00 additional insured value. Values of less than $5,000.00 will not be insured unless a minimum premium of $75.00 is agreed to.
  3. All merchandise transported must comply with, and be subject to all the conditions imposed by item 1610 of this tariff.
  4. All transportation charges due R&M Trucking Co. must be paid in full in order to begin any claim process.

1650 R&M Trucking Co. as Agents:
Definition:
Any consignment negotiated through R&M Trucking Co. on Primary Carrier issued Bill of Lading.

The Primary Carrier assumes all risk of the declared value shown on the Primary Carriers Bill of Lading. The Primary Carrier issuing the Bill of Lading is responsible for insuring the coverage for any excess value declared by the shipper. R&M Trucking Co. maintains minimum liability unless prior written consent is obtained and additional premiums are paid in advance.



1660 Special or Consequential Damages:
R&M Trucking Co. will make all reasonable efforts to affect conveyance. Damages resulting from delay or non delivery can not be assumed by R&M Trucking Co. Natural or man made obstructions will relieve R&M Trucking Co. from any liability with regards to any implied time limitations. Special or consequential damages shall be limited to the transportation charges assessed by R&M Trucking Co.

1670 Special or Consequential Damages:
R&M Trucking Co. does not accept nor access any administration fees associated with a claim process.

1680 Salvage Value:
R&M Trucking Co. retains all rights to any salvage value to merchandise considered subject to claims. Transportation and disposal of such merchandise is at our discretion.

1690 Payment: Transportation Charges;
Any transportation charges not satisfied or disputed within 120 days shall relinquish all rights to the claims process.

1700 Any consignor shall be responsible for all freight charges unless Section Seven is properly completed on the Uniform Bill of Lading.

1710 R&M Trucking Co. shall assume a warehousemen’s lien on all goods undelivered within 15 days unless a prior written agreement exists. Goods will not be released unless storage charges are satisfied

1720 Contracting party will assume all recovery costs associated with bad debt collections. These costs included but are not limited to, collection fees, attorney fee’s, and court costs.
